Arbitration is a dispute resolution process entered into consensually by the disputing parties. It offers a confidential forum for parties to resolve their dispute before an independent decision-maker. Arbitral decisions are made in the form of binding awards that are enforceable through the courts. The SIA standard forms of contract incorporate arbitration clauses. To support these standard forms, the Institute maintains two panels of arbitrators from which the SIA can nominate an arbitrator for disputes arising under the SIA standard forms. The panels comprise architects, engineers, quantity surveyors and lawyers. The dual panel format with the wide range of professional experience that they embrace ensures that disputing parties can have their disputes heard by an arbitrator appropriate to the level of complexity of the arbitration and who has an expertise in relation to the specific issues involved in their dispute.
